These general terms and conditions govern the contractual relationship between Kaviari and any person placing an order on the website kaviari.com/uk (“you” or “customer”) to the exclusion of any other terms that the customer seeks to impose or incorporate, or which are implied by law, trade or course of dealing. By placing your order, you agree to purchase the goods in accordance with these terms and conditions. You are responsible for ensuring that the order details (e.g. delivery address) are complete and accurate.
The products available for sale are those listed on the Kaviari website at the time of the customer's order. Descriptions and features of the products are provided as accurately as possible.Any samples, descriptive matter or advertising produced by Kaviari and any descriptions or illustrations contained on the website are produced for the sole purpose of giving an approximate idea of the goods referred to in them. They shall not form part of the contract nor have any contractual force.
Prices are shown in pounds sterling (£) and include all applicable taxes (including VAT) unless otherwise stated.Delivery fees are provided separately during the ordering process.Every effort is made to ensure that the price of our goods shown on our website is accurate at the time you place your order. Kaviari reserves the right to modify prices at any time, but products will be invoiced based on the rates in effect at the time of order confirmation.
Any order placed on the website constitutes an irrevocable commitment by the customer (“Order”). The Order shall only be deemed accepted when Kaviari issues a written acceptance of the order (“Order Confirmation”) at which point the contract shall come into existence. Such Order Confirmation email will be automatically sent after payment validation.
Payment is made via Stripe, a secure payment platform. We accept commonly used credit and debit cards in the UK. Your payment is processed according to Stripe's terms and conditions, in addition to these general terms and conditions.
Kaviari shall deliver the goods to the location provided by you (the “Delivery Address”). Delivery is completed upon the unloading of the goods at the Delivery Address.You must provide us with a Delivery Address (in addition to a billing address) at the time of your Order. The Order Confirmation shall prompt you to check that your Delivery Address is correct, but it is your responsibility to check that the goods will be delivered to the correct address. You can amend the Delivery Address by contacting us either by telephone or by email from the time you place your Order until we have sent the dispatch confirmation. We reserve the right to charge additional delivery charges if you change your Delivery Address at short notice.Kaviari will ensure that the delivery is accompanied by a delivery note which shows:
Deliveries for the UK market are made through Royal mail or other delivery provider. Once you have placed the products in your basket, you will receive a quote for the different delivery options available. A tracking number will be provided to track the status of your delivery.Please ensure that someone is present at the Delivery Address to receive the parcel, as your Order will require a signature upon arrival. We are not responsible for parcels returned to the courier depot due to the customer's absence.Any date quoted for delivery is approximate only and the actual time of delivery is not of the essence. Any delay in delivery of the goods will not entitle you to terminate or rescind the contract unless such delay exceeds 10 working days. Kaviari shall not be liable for any delay in delivery of the goods that is the fault of the delivery provider , an event or circumstance that is beyond our reasonable control or your failure to provide Kaviari with adequate Delivery Address, delivery instructions or any other instructions that are relevant to the supply of the goods. Please note that Orders placed after 12 pm will be processed on the next working day. Delivery is available only for mainland UK. Orders are dispatched Monday to Thursday. If your Order is placed on a Friday or during a Bank Holiday, it will be processed the following working day and delivered the next day.In the paragraph above, “working day” means a day other than Saturday, Sunday or a public holiday in the United Kingdom.
Kaviari warrants that on delivery the goods shall conform with their description and be free from material defects. The goods supplied by Kaviari are perishable and non-perishable goods so it is important that you follow the instructions and labels on the goods as to their storage and shelf-life.
The risk in the goods shall pass to you once the goods are handed over to the first carrier at the place of shipment. In accordance with Incoterm CIP, Kaviari will provide insurance for the goods during transit until they reach the Delivery Address.Title to the goods shall not pass to you until Kaviari receives payment in full for the goods.
References to liability in this Clause 9 include every kind of liability arising under or in connection with the contract including liability in contract, tort (including negligence), misrepresentation, restitution or otherwise.
In respect of non-perishable goods, you have the right to cancel the contract within 14 days without giving any reason. The cancellation period will expire after 14 days from the day on which you acquire, or a third party other than the carrier and indicated by you acquires, physical possession of the goods. To exercise the right to cancel, you must inform us of your decision to cancel this contract by a clear statement (e.g. a letter sent by post, fax or e-mail).If you cancel the contract, we will reimburse to you all payments received from you (excluding the cost of delivery) without undue delay, and not later than: 1. 14 days after the day we receive the return of any goods supplied; or 2. If earlier, 14 days after the day you provide evidence that you have returned the goods. Such reimbursement will be made using the same means of payment as was used for the initial transaction. The cost of returning the goods is your responsibility.In accordance with UK consumer law, perishable goods such as food products are non-returnable. However, if you receive a defective or incorrect product, please contact our customer service team at info@shop-uk.kaviari.com and we will arrange for the return of the defective product and issue a refund or replacement where appropriate. You have a legal right to reject the goods if they are of unsatisfactory quality, unfit for purpose or are not as described and do not conform to the contract (under the Consumer Rights Act 2015) during the periods set out below: 1. Non-perishable goods – your deadline for rejecting the goods is the end of 30 days beginning with the first day after the goods have been delivered. 2. Perishable goods – your deadline for rejecting the goods is the end of 3 days beginning with the first day after the goods have been delivered.

We collect your personal data when you create an account, place an order, or subscribe to our newsletter. This data includes your name, postal address, email, and phone number.In addition, we collect information about your transactions, device, and IP address to enhance your experience on our website. Your payment details, such as your credit card information, are processed directly by our secure payment provider (Stripe), and Kaviari does not store or have access to this data. Your data is used for processing your orders, delivering your products, and managing your account. These general terms and conditions of sale are governed by English law. Any dispute will be subject to the jurisdiction of the courts of England and Wales.Each party irrevocably agrees that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with the contract or its subject matter or formation.
